The petitioner seeks bail in Naubatpur P.S. Case No. 391 of 2014, registered for the offences punishable under Section 377 of the Indian Penal Code and under Section 4 of Prevention of Children from Sexual Offences Act, 2012.
The victim made very specific allegation against the petitioner that the petitioner committed unnatural offence with him.
Learned counsel for the petitioner submits that the police submitted charge sheet without obtaining the medical report. The petitioner is in jail since 02.08.2014 and he has got no criminal antecedent.
There appears very specific allegation against the
Patna High Court Cr.Misc. No.4204 of 2015 (4) dt.02-04-2015 2/2 petitioner that he committed unnatural offence with the minor victim and other witnesses have also supported the case. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.
The trial court is directed to expedite the trial and conclude the same within nine months from the date of receipt/production of a copy of this order.
