The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 376/511 of the Indian Penal Code and Section 12 of the POCSO Act.
According to FIR, the informant/victim, aged about 14 years, alleged that while she was returning home after purchasing medicine, meanwhile, the petitioner intercepted her and attempted to commit rape with her. Thereafter, this case has been lodged.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to dirty village politics. Further, in fact, the recently elected Mukhiya Navin Kumar was

No.4279 of 2023(3) dt.19-06-2023 2/2 laying pressure on the petitioner to purchase his land, and on refusal by the petitioner to do so, it caused annoyance to him and then he set the informant to lodge this false case against the petitioner and this fact is mentioned in para 8 of the petition. It is further submitted that the petitioner is languishing in judicial custody since 29.9.2022.
Learned APP appearing for the state has opposed the prayer of regular bail and submitted that the informant/victim is minor girl.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bairiya P.S. Case No. 276 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-VII-cum-Special Judge, under POCSO Act, West Champaran at Bettiah.
