The petitioner being the husband of the daughter of the complainant is languishing in custody since 7.01.2016 in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under sections 498A, 406 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

Basic accusation is of torture for non-fulfillment of dowry demand.

On instruction, learned counsel for the petitioner submits that the petitioner admits his marriage with the daughter of the complainant on 13.06.2014 and the present complaint has

Patna High Court Cr.Misc. No.8656 of 2016 (2) dt.22-02-2016 2/2 been filed on 5.07.2014. The complainant has also filed Complaint Case No.961/2007 with similar accusation of torture. In fact, prior to marriage a different girl was shown but subsequently the girl was changed and fraudulently the marriage got performed.

It is submitted by learned counsel for the complainant that the accusation is specific as the petitioner refused to keep the complainant as wife with dignity and honour, which gets reflected from the impugned order.

Considering the nature of accusation, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Gopalganj in connection with Complaint Case No.1822/2014.
