JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-04-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Hathauri P.S. Case No. 238 of 2021, registered for the offence punishable punishable under Sections 272, 273/34 of the Indian Penal Code and section 30(a), 30(c), 32, 41(1) of the Bihar Prohibition and Excise Act, 2016.

15 litres of foreign liquor and 6 liters of spirit has been recovered from house of this petitioner. It is submitted that no recovery has been made from conscious possession of this petitioner. The house in question is in joint possession of the family members. Petitioner is in custody since 11.10.2021 having no criminal antecedent, as stated in para 3 of the petition. Case No. 238 of 2021.
