The petitioner seeks regular bail in connection with Kesariya P.S. Case No. 16 of 2020 instituted for the offences under Sections 366(A), 363 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 01.08.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. As per the prosecution case, on 17.01.2020 at about 07:00 PM, the daughter of the informant namely Alsa Kumari, aged about 14 years and his neighbour's daughter namely Rubi Kumari, aged about 16 years, went outside to attend the call of nature, but they did not return. Thereafter, the informant suspected that this petitioner along with two other persons, named in the F.I.R., have enticed away the girls for the purpose of marriage.

In the statement recorded under Section 164 of the Cr.P.C., there is no whisper against this petitioner. It is further submitted that another co-accused namely, Aklu Ram has already been granted bail by a Co-ordinate Bench of this Court vide order dated 10.06.2021 passed in Cr. Misc. No. 2779 of 2021.
Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody since 01.08.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M, Motihari, East Champaran in connection with Kesariya P.S. Case No. 16 of 2020.
