The petitioners who are Health Educators are claiming parity in the matter of pay scale with Supervisors elsewhere in the State of Bihar.

The State has filed a counter affidavit wherein Annexure A i.e. letter issued by the Principal Secretary Health Department to the Principal Secretary, Finance Department, has been enclosed. A request has been made to the Finance Department to look into the grievance of the petitioners in the light of order passed in CWJC No. 7024 of 2007.

The issue therefore regarding petitioners' entitlement to claim parity with supervisory grade employee in their department has not attained finality as decision is yet to be taken by the Principal

The writ petition therefore need not be kept pending. The same is accordingly disposed of. However, this Court woluld direct the Principal Secretary, Finance Department to take a final decision on the claim of the petitioners pursuant to the communication dated 23.1.2020 issued by the Principal Secretary, Health Department, expeditiously without undue delay and preferably within three months from the date of receipt/production of a copy of this order.
