JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Sahebganj P.S. Case No. 369/2019 registered for the offences punishable under Sections 7 of Essential Commodities Act. Petitioner happens to be the P.D.S. Dealer and the claim of the petitioner is that he had already supplied wheat and rice to bona fide consumers, who were while taking away jointly wheat and rice on a truck, the truck was intercepted by the villagers and, thereafter, seized by officials. Learned counsel appearing for the petitioner submits that bona fide consumers also fortified the above stated claim of the petitioner by filing petitions before the concerned court.

No.1778 of 2020(2) dt.28-02-2020 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that abvoe named petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate (West), Muzaffarpur in Sahebganj P.S. Case No. 369 of 2019 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
