JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 13.9.2014 in a case registered for the offences punishable under Sections 20 and 22 of NDPS Act.

The house of one Basudeo Choudhary was raided from where 50 Kgs. Ganja were recovered. Four persons were found present in the house of Ashutosh Choudhary including the petitioner.

It is submitted by the learned counsel for the petitioner that even assuming the accusation, no offence under the NDPS Act is made out against the petitioner as nothing has been recovered from possession of the petitioner. The recovery, ultimately, was made from the house of Ashutosh Choudhary. Statement has been

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Saharsa in connection with Kishanpur P.S. Case No. 176 of 2014.
