2. The present application has been preferred for the following relief(s):

for issuance a writ in the nature of Mandamus and/or any other appropriate writ, order or direction restraining the respondents in constructing the road over the part area of the raiyati land being Khata no. 133, Plot no. 516 situated in Village - Ishwarpura, Naubrar, Anchal Shahpur, District Bhojpur, Ara, without acquisition of the same and paying compensation to the petitioner in accordance with law.

3. Learned State Counsel has taken this Court to the order passed on 03.11.2025 to show that entire facts were incorporated from the counter affidavit in the said order which

Patna High Court CWJC No.19732 of 2018(5) dt.17-11-2025 2/2 clearly show that the construction of the land has been made under different Thana and not what the petitioner is claiming.

4. Though the Court was convinced that no case is made out, at the insistence of learned Counsel for the petitioner, the same was adjourned for 17.11.2025 enabling him to file reply to the counter affidavit.

5. Today, on call, neither the affidavit is on record nor the learned counsel has bothered to appear.
