The petitioner is accused in connection with Lokahi P.S. Case No. 121 of 2014, registered under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation the name of petitioner has been disclosed by co-accused Syed Saddab Anwar showing the involvement of the petitioner in committing the loot of the truck, except the confessional statement, there is nothing to show his involvement in the present case. Further submission is that petitioner is accused in Brahampura P.S. Case No. 263 of 2014, but he is on bail. Further submission is that similarly situated co-accused, Sarfaraj

Patna High Court Cr.Misc. No.9058 of 2016 (2) dt.28-03-2016 2/2 Alam @ Monu @ Munu has already been granted privilege of bail by a coordinate Bench of this Court vide order dated 03.03.2016 passed in Criminal Misc. No. 6927 of 2016. The petitioner is in custody since 12.10.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani in connection with Lokahi P.S.
