The petitioner seeks bail in Jakkanpur P.S. Case No. 449 of 2018, instituted for the offence under Section(s) 399 and 402 of the Indian Penal Code, Sections 25(1-B)a, 26 and 35 of the Arms Act.

From the impugned order it appears that petitioner claimed himself to be minor in the court below. The court below has directed the petitioner to move before the court of competent jurisdiction.

Counsel for the petitioner submits that petitioner has not moved before the court of competent jurisdiction and come directly to this Court.

Therefore, this Court is not inclined to entertain the

Patna High Court Cr.Misc. No.5888 of 2019(2) dt.04-02-2019 2/2 bail application of the petitioner at this stage. Petitioner is directed to move before the court of competent jurisdiction as directed by the Additional Sessions Judge V, Patna, first.
