The petitioners seek regular bail in Keoti P.S. Case No. 238 of 2012 registered under Sections 302, 201 and 34 of the Indian Penal Code.
The informant alleged that since 05.10.2012 his brother Khekhan Yadav was missing. His dead body was recovered on 08.10.2012. The informant alleged that his brother had illicit relation with Shailo Devi, wife of Shivji Chaupal. The informant suspected that Shivji Chaupal, his wife, brother and brother-in-law might have killed his brother. Learned counsel for the petitioners submits that on mere suspicion, names of the petitioners figured in the case. Coaccused Shailo Devi, Prakash Chaupal and Shivji Choupal have
Patna High Court Cr.Misc. No.4367 of 2015 (2) dt.02-02-2015 2/2 already been enlarged on bail vide Cr. Misc. Nos. 3843/2013, 5656/2014 and 6620/2014.
Considering the facts that on mere suspicion, names of the petitioners have figured in the case and other accused persons have already been enlarged on bail, the above named petitioners are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in Keoti P.S.
