The present writ petition has been filed for direction to the respondents authorities to produce entire record of selection process relating to selection of Sevika in Ward No. 7, Purvi Harihas Panchayat, Hussainganj, District, Siwan and after production thereof the Selection of the private respondent namely, Rekha Devi shall be set aside as she belong to Schedule

Patna High Court CWJC No.20459 of 2018(2) dt.07-10-2024 2/2 Caste Category whereas in the Mapping Panji contained in Memo No. 189 dated 07.10.2017, the Ward No. 7 has majority people of OBC Category. Further, direction be given to the respondents authorities to complete the selection process in the Purvi Harihas Panchayat Ward No. 7 on the post of Sevika on the basis of Mapping Panji contained in Memo No. 189 dated 07.10.2017 whereby the people of OBC were found in majority in Ward No. 7, East harihas Panchayat Hussainganj, Siwan.

3. Learned Counsel for the State raised preliminary objection and submits that petitioner has directly moved before this Hon'ble Court for redressal of her grievances but she has not exhausted her remedy under the relevant Margdarshika for appointment of Anganwari Sevika and Sahiyka.

4. Accordingly, the present writ petition is disposed off directing the petitioner to avail her remedy before the original forum under the relevant Margdarshika for appointment of Anganwari Sevika and Sahiyka within 30 days after the Durga Puja Holidays, if cause of action still survives.
