JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 3.12.2014 in a case registered for the offences punishable under sections 302,341,140, 147 and 148 of the Indian Penal Code and section 27 of the Arms Act.
It is alleged that all the accused persons resorted to firing as a result brother in law of the informant succumbed to the injury.
Considering the nature of accusation and the fact that the case was instituted in 1998 and the period of custody, this court is not inclined to grant bail to the petitioner in connection with S.T. No. 986 of 1999 arising out of Munger Mufassil P.S. Case No. 122 of 1998 pending in the court of the learned 5th Additional Sessions Judge, Munger.
Patna High Court Cr.Misc. No.4607 of 2015 (2) dt.04-02-2015 This application is, accordingly, dismissed.
Let the trial be expedited.
However, in case the trial is not concluded within one year, the petitioner will be at liberty to renew his prayer for bail. (Dinesh Kumar Singh, J) Anil/- U T
