JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The present case, i.e., Lakhisarai Mahila P.S.Case No. 11 of 2015 was registered on the basis of complaint petition filed by the complainant/informant on 8.4.2015 in respect of the occurrence said to be taken place on 25.02.2015 and it is alleged that she was taken to Hawrah by the petitioner and other coaccused and they committed rape on her and also took her nude photographs and, subsequently, they started black mailing her on the basis of aforesaid nude photographs. The statement of victim was recorded under section 164of the Cr.P.C but she, nowhere, stated about the story of rape or taking of her nude photographs and she has only stated that she was taken to Lakhisarai by the

Patna High Court Cr.Misc. No.7511 of 2016 (2) dt.17-02-2016 2/2 petitioner and other co-accused.

The contention on behalf of the petitioner is that the complainant/informant was in love with the petitioner and, as a matter of fact, she solemnized her marriage with the petitioner at her own sweet will but subsequently, under the pressure of her family members, she lodged the present case. Moreover, petitioner has also filed Lakhisarai P.S.Case No. 79 of 2015 against the family members of the informant for kidnapping of the informant of the present case and after filing of the aforesaid case, the present case was lodged.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional District Judge 1st, Lakhisarai in connection with Lakhisarai Mahila P.S.Case No. 11 of 2015.
