JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. According to prosecution case itself, prior to making firing on the informant by the petitioner, two other F.I.R named accused persons had opened fire but firing of the aforesaid accused persons did not hit the informant and after that, petitioner is said to have opened fire causing firearm injury to him. Annexure-3, which is injury report of the informant, reveals that informant sustained pellet injuries, which were found simple in nature. Moreover, submission on behalf of the petitioner is that there was land dispute between the parties and that is the reason of false implication of the petitioner.

Considering the aforesaid facts and circumstances as

No.8591 of 2016 (2) dt.29-02-2016 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Court No. II, Araria in connection with Kursakanta ( Sonamani Godam) P.S.Case No. 56 of 2013.
