====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-02-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Habibpur P. S. Case No. 75 of 2023 in a case registered for the offences punishable under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per F.I.R., this petitioner along with other accused persons committed murder of the brother of informant due to money dispute.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. There is no eye witness of the occurrence and only suspicion has been raised against petitioner and others on account of monetary dispute. Similarly situated co-accused, namely, Gautam Kumar

Patna High Court CR. MISC. No.2322 of 2026(2) dt.13-02-2026 2/2 has already been granted regular bail by co-ordinate Bench of this Court vide order dated 11.12.2023 passed in Cr. Misc. No. 67590 of 2023. Petitioner is in custody since 09.10.2025.

5. However, learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of accusation, period of custody and other facts and circumstances of the case, this bail application is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bhagalpur in connection with Habibpur P. S. Case No. 75 of 2023.
