The petitioner apprehends his arrest in connection with Vaishali (Belsar O.P.) P.S. Case No.426 of 2022 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that nothing has been recovered from conscious possession of the petitioner rather recovery has been made from a shop room no.1 of Patel Market of the petitioner but the said shop was earlier on rent and later on the renter has vacated the shop and it was open for rent purpose. The said market is far away from the petitioner's house. The petitioner has got no criminal antecedent.

No.4627 of 2023(2) dt.28-04-2023 2/2 Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Exclusive Special Excise Court No.II-cum-Additional District and Sessions Judge, Hajipur, Vaishali in connection with Vaishali (Belsar O.P.) P.S. Case No.426 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
