1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 305 and 317(2) of B.N.S., 2023.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that theft was committed in his house and the accused persons after committing theft were fleeing away with golden chain and Rs.50,000/- when three of the accused were apprehended by the villagers and the apprehended accused disclosed the name of the petitioner who managed in fleeing from the place of occurrence.
4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that the name of the petitioner
Patna High Court CR. MISC. No.4449 of 2025(2) dt.12-02-2025 2/2 transpired based on extra judicial confession of the apprehended accused. It is also submitted that petitioner is a person with clean antecedent and is a young boy aged about 19 years and if he is sent to judicial custody, in that event chances are bright that his entire career would get jeopardized and he may come in contact with hardened criminal.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Shivsagar P.S. Case No.467/2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
7. Further, one of the bailors of the petitioner shall be his mother, namely, Rina Devi.
