JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-02-2016 Petitioner is languishing in custody since 06.01.2016 in a case registered for the offences punishable under Sections 323, 379, 406, 494, 498A of the Indian Penal Code.

The basic accusation is of torture and performing second marriage with the consent of the informant. The petitioner was granted anticipatory bail vide order dated 18.03.2013 passed in Cr. Misc. No. 47088 of 2012, on the readiness of the petitioner to make payment of Rs. 1800/- per month to the informant from May, 2013 as interim maintenance by depositing the same in the bank account of the informant by 2nd weeks of every month since informant was not ready to reconcile the issue.

It is submitted by learned counsel for the petitioner that informant did not supply her bank account

Patna High Court Cr.Misc. No.8413 of 2016 (3) dt.25-02-2016 2/2 number, as a result the petitioner could not comply the order and ultimately arrested on 06.01.2016.

Considering the nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saran at Chapra in connection with Trial No. 1100 of 2016, arising out of Mashrakh P.S. Case No. 138 of 2011. The order dated 18.03.2013 passed in Cr.

Misc. No. 47088 of 2012 is hereby rescinded.
