The petitioner apprehends his arrest in Baheri P.S. Case No. 103 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant named the petitioner along with other accused persons and alleged that all the accused persons having arms and weapons came and began to abuse her. When the informant protested, Durga Devi and Sondai Devi caught her hair and Ram Awtar Sharma assaulted her with Khanti on her left hand causing fracture injury. Neelam Devi the daughter-in-law of the informant came to save but Ram Kishore Sharma the petitioner is alleged to have assaulted her with Pharsa on her head. Learned counsel for the petitioner submits that on account of land dispute the occurrence took place. Neelam Devi got one lacerated wound on right side of her head and another swelling on left elbow and both the injuries are simple. Having considered the facts aforesaid and the fact that on account of land dispute some scuffle took place and on account of assault made by the petitioner and others simple injury is caused to Neelam Devi the daughter-in-law of the informant, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Baheri P.S. Case No. 103 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
