2. The petitioner apprehends his arrest in connection with Sahebganj P.S. Case No. 270 of 2023, registered for the offences punishable under Sections 399, 402, 413, 414 of the Indian Penal Code and Section 25(1-b)a/26/35 of the Arms Act.
3. As per prosecution story, on the tip off, the informant along with police personnel raided the Devsar Dak Devi Sthan where some accused persons were found sitting in a suspicious manner. Though, some accused managed to escape but others were apprehended. On search, 3 cartridges and a purse as also a loaded country made pistol were recovered from their possession.
4. The learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.6217 of 2024(2) dt.17-02-2024 2/2 that the petitioner are innocent and have falsely been implicated in this case. He has submitted further that on exactly similar footing co-accused, namely Munna Kumar has been granted anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 425 of 2024.
5. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, West Muzaffarpur in connection with Sahebganj P.S. Case No. 270 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Nawneet Kumar Pandey, J) Nirmal/AKV U T
