The petitioner seeks regular bail in N.D.P.S. Case No. 02/14 arising out of Samastipur Rail (Rail P.P. Hasanpur) P.S. Case No. 36 of 2014, registered for the offences punishable under Section 328 and other Sections of the Indian Penal Code and Section 20 and 22 of the Narcotic Drugs and Psychotropic Substances Act.
According to the prosecution allegation, the informant alleged that male and female came and offered her a cup to tea. The informant became unconscious thereafter the accused persons took her belongings.
Learned counsel for the petitioner submits that Sushil Sah was apprehended and from his possession many theft articles were recovered. Sushil Sah disclosed the name of the
Patna High Court Cr.Misc. No.3668 of 2015 (2) dt.28-01-2015 petitioner. Petitioner was apprehended thereafter but she was not put on Test Identification Parade. However, the informant claims to identify the accused. Petitioner is a lady. She is in jail since 05.05.2014.
Having considered the fact that the name of the petitioner disclosed by the co-accused and nothing has been recovered from the possession of the petitioner, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional District and Sessions Judge, Samastipur in connection with Samastipur Rail (Rail P.P.
