Case No. 411 of 2014 registered under Sections 302 and 201/34 of the Indian Penal Code and accordingly, both the above stated petitions are being disposed of by this common order. Heard learned counsel appearing for petitioners as well as learned Additional Public Prosecutor for State. Also heard learned counsel appearing for the informant.

Patna High Court Cr.Misc. No.3665 of 2015 (3) dt.21-04-2015 2 / 2 No doubt, petitioners are named in the First Information Report but admittedly informant is not an eye witness of the alleged occurrence. In course of investigation, witnesses expressed suspicion against these petitioners and only stated to this extent that co-accused Mobin Azad was seen near the clinic of Dr. Tuntun Rai and after that petitioners along with co-accused Mobin Azad proceeded by tempo.

No doubt, the dead body of victim has not been recovered as yet but considering the facts and circumstances of the case as well as materials available on the case diary, let petitioners above named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Runi Saidpur P.S. Case No. 411 of 2014.
