Heard the parties.
The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 272/273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.
Liquor was allegedly recovered from the house of the petitioner.
Submission is that the house is occupied by other family members of the petitioner. However no other family member is accused in this case. Petitioner has got no criminal antecedent.
Since recovery is alleged from the house of the
Patna High Court CR. MISC. No.14670 of 2021(2) dt.22-11-2021 2/2 petitioner and there is bar of entertainment of prayer for anticipatory bail under Bihar Prohibition and Excise Act, I am not inclined to enlarge the petitioner on anticipatory bail in connection with Sakra P.S. Case No. 99 of 2020. Hence, prayer is refused.
The petitioner may surrender and pray for regular bail.
