The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.

Kishori Yadav named eight persons and alleged that they all dragged his son Ashok Yadav from a tractor and took him to the maize filed. The accused persons cut the neck of his son and took away the head along with them. It is submitted that the petitioner is not named in the F.I.R. No specific allegation is made against the petitioner. During the course of investigation, the petitioner was found talking with Bijay Darshan, driver of Doman Darshan, on the date of occurrence and he also visited the house of co-accused Mrityunjay Yadav, who is named in the F.I.R. Considering the facts that the informant did not name the petitioner in the F.I.R. and name of the petitioner figured in the

Patna High Court Cr.Misc. No.12083 of 2015 (2) dt.10-04-2015 2/2 case during the course of investigation but nobody has alleged that the petitioner also took part in killing of Ashok Yadav, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Adhoc A.D.J. VIII, Munger in Bariyarpur P.S. Case No. 27/2013, corresponding to G.R. No. 478 of 2013.
