JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 364, 511, 384, 504/34 of the Indian Penal Code, 27 of the Arms Act and 3⁄4 of Explosive Substance Act.

Petitioner is said to have been caught on the spot but submission on behalf of the petitioner is that an altercation had taken place between informant and others including petitioner on the point of demand of donation on the eve of Durga Puja but informant lodged this case with exaggerated story. Moreover, petitioner is in jail custody since 24.10.2015 and the investigation against the petitioner has already been completed.

No.10489 of 2016 (2) dt.04-03-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Samastipur in connection with Tajpur (Halai) P.S. Case No. 334 of 2015.
