The petitioner is accused in connection with Maker P.S. Case No. 127 of 2015, registered under Section 414 of the Indian Penal Code.

The accusation is that on seeing the Police one person started to flee away leaving a motorcycle, but he was apprehended by the Police, who disclosed his name as Md. Akbar Miyan (petitioner), but on query, he did not furnish any paper regarding ownership of the said motorcycle. Learned counsel appearing on behalf of the petitioner submits that it would appear from the seizure-list that the alleged motorcycle was recovered by the Police near the turning of the canal of village Phulwariya. No.9204 of 2016 (2) dt.31-03-2016 2/2 that, in fact, the petitioner is accused in five other cases, in which petitioner is on bail, and due to that reason, the name of the petitioner has also been implicated in the present case by the Police showing the recovery of the motorcycle from the possession of the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Maker P.S. Case No. 127 of 2015. Out of two sureties, one surety must be parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
