The petitioner apprehends his arrest in connection with Panjwara P.S. Case no. 25 of 2019, registered under Section 30(a) and 32(2) of the Bihar Prohibition and Excise Act, 2016.
The accusation is that in course of checking of the vehicle, one Vijay Das was apprehended with motorcycle bearing registration No. BR-51A-6690. On search of the motorcycle, one liter country made liquor recovered from the dickey of the motorcycle.
Learned counsel for the petitioner submits that, admittedly, the petitioner is the owner of the seized motorcycle and his motorcycle was taken by one Vijay Das for some urgent
Patna High Court CR. MISC. No.2722 of 2020(2) dt.18-01-2020 2/2 work for going to anywhere. Further submission is that the petitioner has no knowledge about keeping of alleged liquor in the dickey of the motorcycle. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J-II, Banka in connection with Panjwara P.S. Case No. 25 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
