The petitioner apprehends his arrest in a case registered for the offence under Section 307, 379 & other allied sections of the Indian Penal Code.

As per F.I.R., on 12.12.2017 at 12.15 PM, while the informant was sitting in his hut, in the meantime, all the F.I.R. named accused persons including this petitioner came and assaulted informant and his family members. It is further alleged that the accused persons also set the hut of informant on fire. It is submitted on behalf of petitioner that due to land dispute between the parties, this false and concocted case has been lodged against this petitioner. Allegation of assault is general and omnibus. Police, after investigation, has not found case true under Section 436 of the IPC. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.3534 of 2023(2) dt.28-03-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka in connection with Rajoun P.S. Case No. 634 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
