This is an application for regular bail on behalf of the petitioners for the offences alleged under Sections 20(b)(ii) (c), 22 of the NDPS Act, registered in connection with Industrial Area P.S.Case No. 163 of 2022 (NDPS Case No. 97 of 2022).

The learned counsel for the petitioners has submitted that as per allegation, 500 gm of ganja each was recovered from the possession of the petitioners. They are the persons of clean antecedent and are languishing in jail since 22.08.2022. Considering the above facts and circumstances and

No.3469 of 2023(2) dt.06-04-2023 2/2 clean antecedent, let the petitioners, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-1, Bhagalpur in connection with Industrial Area P.S.Case No. 163 of 2022(NDPS Case No. 97 of 2022), subject to the following conditions:-

1. The petitioners shall cooperate in the disposal of trial and make available available as and when required by the court.

2. If the petitioners are found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioners and the learned court below will take decision in accordance with law.
