JUSTICE SHIVAJI PANDEY ORAL ORDER 19-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. In this case the petitioner seeks regular bail in connection with Garhpura P.S. Case No.15/15 arising out of S.Tr. No.462/15 for the offences under Sections 307, 323, 333, 353,34 of the I.P.C. and 25 (1-B)a 26, 27 of Arms Act. As per the allegation the petitioner and others had gone to the medicine shop of the informant and the petitioner demanded extortion money Rs.3/- lacs and had threatened for dire consequences upon non-fulfillment of the same as well as the nephew of the informant had already deposed in the court below against one of the co-accused. It has also been alleged that the petitioner had resorted firing from a country made pistol with

Patna High Court Cr.Misc. No.8079 of 2016 (3) dt.19-04-2016 2/2 intent to kill the nephew of the informant but he escaped. The local people gathered and caught hold of the petitioner at the spot. But three accused persons succeeded in fleeing away. In course of firing chaukidar sustained injury.

In such view of the matter, I am not inclined to grant bail to the petitioner.

The prayer for bail of the petitioner is, accordingly, rejected.

However, the petitioner will be at liberty to renew his prayer for bail after six months from today. (Shivaji Pandey, J) AnilKrSinha/- U T
