Mr.Ajay Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-01-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is languishing in custody since 11.10.2018 in connection with Dumra P.S. Case No.382 of 2018 registered for the offences punishable under Sections 188, 414 of the Indian Penal Code and read with Section 52 of the Prisoner Act.

From the possession of the petitioner, one mobile, battery and SIM card were recovered.

It is submitted by learned counsel for the petitioner that in fact petitioner filed a Cr. Writ being Cr.W.J.C No.1968 of 2018 before this Court against Superintendent of the Sitamarhi Jail. Since the Superintendent of Jail did not transmit a letter of the petitioner which was to be submitted before the learned

Patna High Court Cr.Misc. No.2235 of 2019(2) dt.17-01-2019 2/2 C.J.M., Sitamarhi. Hence, maliciously the present case has been lodged. Petitioner is also accused in two other cases apart from the present case.

Considering the nature of accusation and the period of custody, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Dumra P.S. Case No.382 of 2018.
