JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-02-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sessions Trial No. 119 of 2018/314 of 2018 arising out of Daudnagar P.S. Case No. 22 of 2012 for the offenses under Section 395 of the Indian Penal Code.

By order dated 3.7.2018 passed in Cr. Misc. No. 27743 of 2018 while declining to grant bail to the petitioner, the Court directed the trial court to expedite the trial and conclude the same within six months. In case the trial is not concluded within the aforesaid period, liberty shall be available to the petitioner to renew his prayer for bail.

Learned counsel for the petitioner submits that despite the direction issued by this Court, the trial has not been

Patna High Court Cr.Misc. No.5688 of 2019(2) dt.06-02-2019 2/2 concluded within the period of six months and the petitioner has renewed his prayer for bail after expiry of six months period as indicated in the order dated 3.7.2018 passed in Cr. Misc. No. 27743 of 2018.

Considering the observations and liberty granted by this Court earlier, the court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-II, Aurangabad in connection with Sessions Trial No. 119 of 2018/314 of 2018 arising out of Daudnagar P.S. Case No. 22 of 2012. However, the Trial Court is directed to expedite the trial and conclude the same within a period of six months on day to day basis.
