JUSTICE SHIVAJI PANDEY ORAL ORDER 15-06-2015 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in GRP Jhajha P.S.Case No. 25 of 2013 u/s 328 & 379 IPC.

It appears from the FIR that the victim was administered poison though cream biscuits and thereafter the accused persons robbed away the victim. From the possession of the petitioner, mobile of the victim was recovered and he also confessed his guilt before the Police.

Counsel for the petitioner submits that so far criminal history is concerned, there is error of records in the impugned order and as per statement made in para 9 and 9(A) of this petition, petitioner has no criminal history. Looking to the facts and circumstances of the case,

Patna High Court Cr.Misc. No.16732 of 2015 (2) dt.15-06-2015 2/2 this Court is not inclined to grant bail to the petitioner for the present. His prayer for bail is rejected. However, if so advised, petitioner may renew his prayer after completion of one year in custody.
