It is case of misuse of privilege of bail for near about 11 years and while rejecting bail petition of the petitioner by Addl. Sessions Judge II, Aurangabad vide order dated 2.2.2016 passed in BP no. 61 of 2016/4 of 2016, the aforesaid court directed the petitioner to renew his prayer for bail after examination of three chargesheeted witnesses or after four months whichever is earlier and, therefore, I do not find any ground to interfere in the impugned order. Accordingly, this bail petition filed in connection with Aurangabad (Town) P.S. case no. 79/2001 pending in the court of Sri Mahavir Prasad, Judicial Magistrate, Ist Class, Aurangabad stands disposed of.

However, petitioner may renew his prayer for bail in the light of order dated 2.2.2016 passed by Addl. Sessions Judge II,

Patna High Court Cr.Misc. No.8501 of 2016 (2) dt.26-02-2016 Aurangabad. This order shall not cause any prejudice to the case of the petitioner.
