JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Present case has been lodged on the basis of written report submitted by brother of the petitioner and it is alleged that F.I.R named accused as well as one unknown person had made indiscriminate firing causing injury to an innocent child but in course of investigation, police came to the conclusion that the informant of the present case lodged the case with concocted story and, accordingly, petitioner and his brother, who happens to be the informant in the present case, have been made accused in this case.

No doubt, petitioner carries criminal antecedent of several cases but it appears that in the present case, except

Patna High Court Cr.Misc. No.8585 of 2016 (2) dt.01-03-2016 2/2 suspicion, there is nothing against the petitioner. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Begusarai in connection with Naokothi P.S.Case No. 83 of 2014.
