Petitioner is aggrieved by the order dated 03.12.2016 passed by Collector, West Champaran, Bettiah contained in Annexure-3.

The Collector while exercising quasi judicial power is expected to act reasonably but the order does not indicate application of mind.

From perusal of Annexure-3, it appears that the Collector has not assigned any reason for dismissing the appeal. Considering the aforesaid, the order of the collector (Annexure-3) is hereby quashed. The matter is remitted back to

Patna High Court CWJC No.4426 of 2017(3) dt.21-12-2019 2/2 the Collector, who is required to take fresh decision after application of mind. Necessary decision in this regard must be taken within a maximum period of three months from the date of receipt/production of a copy of this order. With the aforesaid, the present writ petition stands disposed of.
