The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Prohibition Amended Act, 2018.

The accusation is of recovery of 60.5 liters country made liquor concealing in the field of this petitioner. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that there has been partition of the property between the petitioner's brother and according to partition plot no.811 Khata no.312 village Haspura was allotted to petitioner and Khata No.311 plot no.774 area 0.55 decimal was allotted to Daroga Ram and further submits that no illegal liquor was

Patna High Court CR. MISC. No.4087 of 2022(2) dt.14-06-2022 2/2 recovered from the possession of the petitioner's land. Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts that the liquor was recovered from the possession of the petitioner's land, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail is rejected.
