Heard the learned counsel for the petitioner and learned APP for the State.

This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 304(B) and 12(B)/34 of the Indian Penal Code, registered in connection with Wazirganj P.S.Case No. 135 of 2016.

As per allegation, the marriage of the cousin sister of the informant was solemnized with co-accused Jitendra Manjhi. The members of matrimonial house assaulted her. The informant came to know that his cousin sister died due to strangulation. He

The learned counsel for the petitioner has submitted that the petitioner is the brother-in-law (bhainsoor) of the deceased and he has no relation with dowry demand. He has submitted further that on similar allegation, mother-in-law and father-in-law of the deceased has been granted regular bail in Cr.Misc. No. 12548 of 2017 vide order dated 28.03.2017. He has also submitted that the petitioner is under custody since 28.07.2021.

Considering the above facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Gaya in connection with Wazirganj P.S.Case No. 135/2016, subject to the following conditions:-

1. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

2. If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
