Petitioner apprehends his arrest in a case registered under Sections 420, 467, 468, 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act. Allegation is recovery of 3.330 litres of illicit foreign liquor from the motorcycle of the petitioner who fled away after leaving motorcycle on seeing the police.

As illicit liquor has been recovered from the motorcycle of petitioner, as such, present anticipatory bail

Patna High Court CR. MISC. No.2190 of 2020(2) dt.16-01-2020 2/2 petition under excise act is not maintainable and is accordingly dismissed.

However, petitioner is directed to surrender before the special court within four weeks from the date of order and make prayer for regular bail, and if he does so, the special court will hear the bail application of the petitioner and dispose it of on the same day, without being prejudiced by this Order.
