ANJANA PRAKASH ORAL ORDER 20-04-2016 The petitioner seeks anticipatory bail in connection with Sathi P.S. Case No. 165 of 2013 for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 354, 380, 448, 427,504 of the Indian Penal Code 3(i) (X) of the SC/ST Act and 27 of the Arms Act pending before the Chief Judicial Magistrate, Bettiah, West Champaran.

The petitioner was granted anticipatory bail in Cr. Misc. No. 16256 of 2015 by order dated 28.05.2015 but on condition that an affidavit will be filed on her behalf that she has fair antecedent. Since one other case was pending against her such an affidavit could not be filed. Hence she filed second anticipatory bail which is not maintainable.

Under peculiar circumstances that the petitioner is a

Patna High Court Cr.Misc. No.8353 of 2016 (2) dt.20-04-2016 lady she is directed to appear before the Court below which shall consider the fact that earlier she was found fit to be released on anticipatory by this Court and pass appropriate order. The application stands disposed off.
