JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-02-2016 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under sections 394 of the Indian Penal Code.

Name of the petitioner came in this case in the confessional statements of co-accused and it appears that except the aforesaid confessional statement there is nothing against him. The petitioner does not have any criminal antecedent and so far as recovery of mobile is concerned, learned counsel for the petitioner submits that looted mobile has not been recovered from possession of the petitioner.

Considering the aforesaid facts and

Patna High Court Cr.Misc. No.8289 of 2016 (2) dt.25-02-2016 circumstances of the case as well as submissions of the parties, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Araria in connection with Araria P.S. Case No. 639 of 2015.
