The petitioner is apprehending his arrest in connection with Khagaria P.S. Case No. 648 of 2016, registered under sections 468, 471, 467 420 and 120B/34 of the Indian Penal Code.

Allegation against the petitioner is of committing forgery by manipulation in the marks sheet and instead of showing 48.5 % marks, it has been shown 79.2 %.

It has been submitted that the petitioner had not prepared the merit list and as such no case is made out against the petitioner.

Heard learned A.P.P. also who has opposed the

Patna High Court Cr.Misc. No.17953 of 2017 (2) dt.01-05-2017 prayer for bail.

Having heard both sides and in view of the aforesaid facts, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks and make prayer for regular bail, which will be considered by the learned court below on the same day without being prejudiced by the order of this Court.

With the aforesaid observation, this application is disposed of accordingly.
