Petitioners seek bail in GO (Excise) Case No.1040 of 2018/ Singhwara P.S. Case No.237 of 2018 instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act, 2016.
It is alleged that total 180 litres Nepali liquor has been recovered from the car on which these petitioners were found sitting along with another other accused.
Counsel for the petitioners submits that Petitioners are in custody since 22.11.2018 having clean antecedents. Counsel for the petitioners further submits that co-
Patna High Court Cr.Misc. No.2620 of 2019(2) dt.06-02-2019 2/2 accused, Braj Kishore Yadav, has already been granted regular bail by co-ordinate Bench of this Court by order dated 17.01.2019 passed in Cr. Misc. No.2341 of 2019. In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the V ADJ cum Special Judge, Excise, Darbhanga, in connection with GO (Excise) Case No.1040 of 2018/ Singhwara P.S. Case No.237 of 2018, subject to the condition that both the bailors shall be close relative of the petitioners.
