The petitioner seeks regular bail in connection with N.D.P.S. Case No. 126 of 2021 arising out of Town P.S. Case No. 683 of 2021 instituted for the offences under Sections 8(c), 21(B) and 22 Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned counsel for the petitioner submits that the petitioner is in custody since 09.09.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that allegation is of recovery of 17 sachets containing 6.939 grams smack like substance along with a mobile from the possession of the petitioner.

Learned counsel for the petitioner further submits that

Patna High Court CR. MISC. No.4368 of 2022(2) dt.06-06-2022 2/2 petitioner has been falsely implicated in the present case and nothing was recovered from the possession of the petitioner. It is further submitted by the learned counsel for the petitioner that the seized articles measures 6.939 gram is just above small and less than the commercial quantity. Petitioner is a young man, aged about 28 years.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 09.09.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of learned Vth Additional Sessions Judge, Muzaffarpur in connection with N.D.P.S. Case No. 126 of 2021 arising out of Town P.S. Case No. 683 of 2021.
