====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-05-2025 Heard learned counsel for the petitioner and the State.

2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 363/366A/34 and 506 of the Indian Penal Code and section 8 of the POCSO Act.

3. As per the prosecution case, petitioner along with other accused persons kidnapped 17 years old minor daughter of the informant.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He submits that the victim, in her statement recorded under section 161 of the Code of Criminal Procedure, stated that she herself fled away from her house with Passbook and Aadhar card and reached Dhaka. Petitioner received her in Surat station and also lived with her one night. However, victim, in her statement recorded under section 164 of the Code of Criminal Procedure, has not named this petitioner and stated that she herself left the house. Age of the petitioner, as per school certificate, has been stated to be 18 years. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the prayer

6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge VII cum Special Judge, POCSO Act, Motihari, East Champaran in Patahi Police Station Case No. 350 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
