The petitioner is languishing in custody for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307 and 504/34 of the Indian Penal Code. Later on Section 302 IPC was added.
There is general and omnibus allegation against 16 F.I.R. named accused persons including the petitioner of commission of murderous assault to the father of the informant, as a result whereof, father of the informant died subsequently during the course of treatment. The doctor has found head injury as cause of death. However, the allegation is not specific. Land dispute is reason behind the occurrence. Hence chances of over implication cannot be ruled out. Petitioner is in custody since 13.08.2020. Investigation of the case is already complete. There
Patna High Court CR. MISC. No.14304 of 2021(3) dt.08-09-2021 2/2 is nothing on the record to substantiate that the petitioner is going to tamper with the evidence or would be non-cooperative in the trial.
Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Laukaha P.S. Case No. 226 of 2020, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
