JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Balthar P.S. Case No. 104 of 2013 registered for the offences punishable under Sections 341, 323, 379, 354 B, 504/34 of the Indian Penal Code, Section 8 of POCSO Act.
It would appear from perusal of the first information report itself that the altercation took place between the parties due to petty dispute.
The submission on behalf of the petitioner is that the story of theft as well as story of outraging the modesty of informant's daughter is nothing but only a super addition with an intent to make the offence graver.
Patna High Court Cr.Misc. No.14899 of 2015 (2) dt.10-04-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge-cum-Special Judge, West Champaran, Bettiah in Balthar P.S. Case No. 104 of 2013 subject to condition as laid down under Section 438(2) of the Cr.P.C.
