JUSTICE PARTHA SARTHY ORAL ORDER 22-07-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Gamahariya P.S. Case no.160 of 2020 registered under sections 25(1-B)(a) and 26 of the Arms Act.

As per allegation in the F.I.R, a loaded country-made Katta and a separate live cartridge were recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has been falsely implicated in this case because of his antecedents. He is in custody since 27.9.2020 and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for over nine months, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Gamahariya P.S. Case no.160 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Madhepura.
